Pre-Inspection Agreement

This is an Agreement between you, the Seller of the property for which an inspection is being requested or the designated agent of the Seller (hereafter referred to as the “Client”), and us, Done Right WSI LLC. This agreement is pertaining to our inspection of the well or septic system at the property for which the inspection is being requested. The terms below govern this Agreement. The fee for our inspection will be collected online; payment terms and conditions are described online as well.

SEPTIC INSPECTION

·        We will perform a visual inspection of the septic system by evaluating the tank(s) and absorption system.

·        Septic tanks will be evaluated by measuring the external dimensions to determine general size, exposing one lid on the septic tank(s), removing the lid, and performing a visual inspection.  Septic tank walls will be visually inspected for signs of deterioration. Condition of tank baffle(s) (if present) will be determined, and the level of effluent in the tank will be assessed.

·        Absorption systems will be probed and measured to determine design and size, and a boring will be conducted into the system stone (if applicable) to determine the condition of the system. 

·        Wastewater outlet(s) will be located when accessible from a crawlspace or basement to determine the source and to evaluate any connections to the sewage disposal system that may be reduce its lifespan.

·        In some instances the tank(s) or absorption system may not be locatable. If this occurs, additional expenses may be incurred to locate system components; applicant will be notified and additional expenses will not be incurred without the authorization of the homeowner or their designated agent.

·        Done Right Well WSI LLC is not responsible for damage to any septic system components.

·        Records pertaining to the septic system will be requested by Done Right WSI LLC from the licensing jurisdiction.  Pertinent records will be included with the inspection report.

·        Once the inspection is completed an inspection report and any applicable educational information will be provided to the Client.

·        A written report will be provided identifying any notable defects in the system. System will be provided with a rating. Any recommendations will be noted in the report as well.

WELL INSPECTION

A. WATER SAMPLE COLLECTION AND ANALYSIS

·        Water samples will be collected using methods outlined in the Quick Guide To Drinking Water Sample Collection, Second Edition, Edited published by the United States Environmental Protection Agency; specific sampling methods that apply to total coliform bacteria, nitrates, and lead (if applicable) will be utilized. ·        Once collected, samples will be delivered to and analyzed by a laboratory recognized by the Michigan DEQ and the United States Environmental Protection Agency as a Certified Drinking Water Analysis Laboratory.

·        If initial results reveal that the water is positive for total coliform bacteria, system may be flushed by the applicant or homeowner and resampled by Done Right WSI, LLC for a fee of $75. If the 2nd sample yields positive results for total coliform bacteria, then it is recommended that well driller licensed in the state of Michigan chlorinate the well and water supply system. Additional sampling will only be provided after payment is received.

·        Water test results will be limited to biological contaminants requested by the Client (coliform bacteria, nitrates and/ or lead).

B. WELL INSPECTION AND REPORT

·        If accessible well head will be evaluated for any visible signs of disrepair.

·        Pressure tank and pressure gauge will be evaluated for any visible signs of disrepair.

·        A water sample will be collected at the time of the inspection and sent to a Certified Drinking Water Analysis Laboratory for analysis for the requested contaminants. Water sampling will be conducted as outlined in Section A, “Water Sample Collection and Analysis.”

·        Records pertaining to the well will be requested by Done Right WSI LLC from the licensing jurisdiction.  Pertinent records will be included with the inspection report.

·        A copy of the water sample analysis, applicable educational materials, and inspection report will be provided to the applicant.  When a well log is available on the Michigan DEQ Wellogic System, it will be provided with the inspection report.

·        A written report will be provided identifying any notable defects in the system. System will be provided with a rating. Any recommendations will be noted in the report as well.

GENERAL

·        LIMITATION ON LIABILITY AND DAMAGES. The Client hereby releases and exempts Done Right WSI LLC and its agents and employees of and from all liability and responsibility for the cost of repairing or replacing any unreported defect and for any consequential damage, property damage, or personal injury of any nature. In all cases, our liability is limited to liquidated damages in an amount not greater than the fee you paid us. You acknowledge that this liquidated damages is not a penalty, but that we intend it to: (i) reflect the fact that actual damages may be difficult or impractical to ascertain; (ii) allocate risk between us; and (iii) enable us to perform the inspection for the agreed-upon fee.

·        THE INSPECTION AND REPORT ARE NOT A GUARANTEE OR WARRANTY that the well and/ or septic system or system components are defect-free, or that concealed defects do not or will not exist. Problems may exist even though signs of such may not be present during the inspection. No indication is made as to how long any well or septic system will continue to function. Some components of a well or septic system may not be accessible for inspection; in these instances the report will indicate “Inconclusive” for that component of the system. Inspection reports are an indicator of the present condition of the well or septic system. A report with a “good” or “fair” rating does not guarantee the ongoing function of the system. 

·        Unless otherwise noted we will perform the inspection in accordance with standards outlined in this contract, and if applicable we will perform the inspection in accordance with the governing jurisdiction’s standards, or in accordance with standards set forth by the lender.

·        Our inspection and report are for the Client only.  The Client gives us permission to discuss our observations with real estate agents, owners, or other interested parties. The Client will be the sole owner of the report and all rights to it.  We are not responsible for use or misinterpretation by third parties. If The Client or any person acting on behalf of The Client provides the report to a third party who then takes legal action against us, The Client releases us from any liability and agrees to pay our costs and legal fees in defending any action naming us.

·        It is the responsibility of the homeowner to locate and stake utilities, sprinkler lines, and other underground infrastructure. Done Right WSI LLC is not responsible for damaged utilities, sprinkler lines, or other underground infrastructure. It is the responsibility of the Client to Call MISS DIG at 811 to have utilities flagged. If an inspection is requested with less than 72 hours of notice, MISS DIG may be unable to locate and flag underground infrastructure.

·        If there is more than one Client, you are signing on behalf of all of them, and you represent that you are authorized to do so.
